Can an institution require its employees to take a substance that might kill them?
In August 2020, the CDC’s Advisory Committee on Immunization Practices (ACIP) convened to discuss the development of COVID-19 vaccines. During the meeting, ACIP’s Chief Medical Officer, Dr. Amanda Cohn, reminded attendees that vaccines approved under an Emergency Use Authorization (EUA) could not be legally mandated.
“I just wanted to add that, just wanted to remind everybody, that under an Emergency Use Authorization, an EUA, vaccines are not allowed to be mandatory,” she stated. “So, early in the vaccination phase, individuals will have to be consented and they won’t be able to be mandated.”
Dr. Cohn’s statement is accurate. The same Federal Food, Drug, and Cosmetic Act that allows the FDA to grant an EUA for a vaccine also requires that persons be given the option to refuse that vaccine. This legal framework aligns with the Due Process Clause of the Fourteenth Amendment, which protects the right to decline medical treatment.
